THE BILL TO PROHIBIT FORCED GOVERNMENT UNIONIZATION

Summary: A bill for an act relating to labor relations; enacting the Family Freedom Act; proposing coding for new law in Minnesota Statutes, chapter 179A.

Section 1. [179A.015] FAMILY FREEDOM ACT.

Subdivision 1.  Title. This section shall be known as the Family Freedom Act.

Subd. 2 Prohibition. A self-employed individual shall be considered an independent contractor as provided for under the National Labor Relations Act, United States Code, Title 29, Chapter 7, Subchapter II, Section 152, even if some or all of the funding for any service provided to any client of the individual comes from a governmental subsidy.

Self-employed individuals may not form or join a labor or employee organization under authority of the Public Employment Labor Relations Act, Minnesota Statutes Chapter

179A, Minnesota Statutes Chapter 179, or any other law. Individuals subject to the prohibition in this section include, but are not limited to, child care providers and personal care attendants.

EFFECTIVE DATE. This section is effective the day following final enactment.
